Effective January 1, 2021, recently passed Florida Statutes Section 448.095 imposes new requirements upon public employers, contractors and subcontractors, including Children’s Services Council of Broward County (“CSC”) and its providers and contractors, and their subcontractors, regarding the verification of authorized work status of new and renewal hires through e-Verify or other means. This notice is for your convenience only, and is not legal advice. You are advised to seek legal counsel regarding these changes and their application to you and/or your organization, contractors and subcontractors.

Effective January 1, 2021, all new contracts between CSC and its providers/contractors will require that “the CSC provider/contractor swears and affirms that, in accordance with Florida Statutes Section 448.095, such CSC provider/contractor

(a) uses the e-Verify system to verify the work authorization status of all newly hired employees, contractors and subcontractors, and all employees, contractors, and subcontractors working on federal contracts,

(b) does not employ, contract with, or subcontract with an unauthorized alien,

(c) has obtained affidavits from its applicable subcontractors swearing and affirming that such subcontractor does not employ, contract with, or subcontract with an unauthorized alien, and (d) will maintain a copy of any such subcontractor affidavits for the duration of the applicable CSC contract.”
